Case Study

Condominium Association

The firm successfully represented a group of unit owners in the Superior Court of New Jersey, Hudson County, who opposed a single unit owner’s allegation that a subject corridor, in the newly constructed condominium, was for the exclusive use of the single unit owner. The firm successfully argued that the single unit owner’s allegation was without merit because despite the developer’s representation to the single unit owner, the subject corridor was consistent with both the Master Deed and New Jersey Condominium Act’s definition of “common element” as it was clearly intended for “common use”. Hence, the firm prevailed on summary judgment.
